They were in Dallas for the State Fair of Texas, hoping to make some connections so they could open up their own booth the next year. The father and son run Diamond Dawgs, a late-night spot in Norman, Okla. After their research, Simon, his son and a group of his son's friends took an Uber-style limo service to Katy Trail Ice House in Uptown for a drink. A few hours later, Simon was in handcuffs, his Achilles' tendon was torn and he was furious.

This week, the restaurateur sued Katy Trail Ice House, alleging assault and negligence. But the managing partner of Ice House, Buddy Cramer, says that before the scuffle Simon was spouting racial slurs at his employees. He promises to fight the suit. According to his lawsuit, Simon, his son and the friends visited the bar on Oct. Simon's lawyer, Scott Palmer, said a busboy at the restaurant walked past them and muttered something under his breath.

They didn't think anything of it until an Ice House employee, who is believed to be a bouncer, approached them in a "threatening" manner, accused them of making racist comments toward another employee, grabbed Patrick's beer and slammed it on the ground, the suit says.

Cramer has a different story. He said Simon and his son were unhappy with the way the busboy cleaned up their table, so they started using a derogatory term for people of Mexican descent to his face.

Then the bouncer, who is black, told them they needed to leave. Instead, Cramer says, they refused and used the N-word.
